HIGH IMPORTANCE this come via Jenny Clarke if you are in the situation where you can claim neither ESA or JSA you can claim Income Support this has been found out via an FOI below:

They certainly kept this quiet in Government as many where under the impression Income Support (IS) had ended.

      I suspect that the “unable to work because you’re sick or disabled” criterion only applies if you’ve not yet been migrated to ESA

    How does this work for people migrating from Income Support on the grounds of Incapacity to ESA? That’s around a third of people being migrated from what most people think of as ‘incapacity benefits’ and usually people affected by illness or disability from an early age and unable to build up NI credits for Incapacity Benefit itself before the concept of ‘in youth’ credits were created.

    How can they claim the benefit they were claiming in order to claim the benefit they’ve been told they must claim? It doesn’t make sense. Wouldn’t they be better to try claiming a new ESA claim on a detoriation of condition or change of circumstance? The Income Support route for incapacity stopped accepting new claims in 2010 when the ESA migration began.

    Has anyone tried this instead of doing a simple theoretical?

    income support also entitles people on mid-high rate dla to an additional £59 severe disablement allowance IF they have no-one claimin carers allowance. However, if u r on ESA, which nearly all sick claimants are, u cannot get this extra payment

      Yes you can. I’m on ESA and get the Severe Disability Premium. It’s included in the ESA payment, rather than a separate Income Support payment like it used to be with Incapacity Benefit.

    We don’t know of anyone who’s done this yet. We’ll have to wait and see. Spread the word meanwhile and I’m sure there’ll be lots of applications soon 🙂

    I attempted to claim Income support after they illegally stopped my claim for incapacity paid as income support in March of this year. They repeatedly refused to acknowledge what it stated on their website, then refused to process the application.

    The reason for refusal to process, was not the law, their website or anything else. Their automated system,instructs them to refer it directly back to ESA. So although they do agree their are grounds to claim, their system won’t let them process it.

    So they didn’t refuse to process it, they stated they couldn’t do that because their IT system didn’t have the capacity, is that right? Did you get this in writing at all? Why was it they stopped your original Incap-related IS in the first place please?
