A lady came in to see me today. She was beside herself as the DWP had treated her very badly over numerous different aspects of her claim. She had been misled and lied to, but this is the thing that’s making me want to roll some heads…

Her phone call to DWP last year….

Lady: I am calling to inform you of changes to my health; I now have cancer.
DWP: Well?
Lady: I was told to inform you of any changes to my health.
DWP: Well, are you going to die?
Lady: I’m not sure. I’ve only just been diagnosed.
DWP: Well, I can put you through on the special rules for terminal claimants, but if you don’t die within six months we will prosecute you.

She was so taken aback, she didn’t get any names.

WTF are these creatures they employ?

I’m going to enjoy writing this letter of complaint. Bastards.

      Atos has informed me their assessors are not subject to criminal record checks and I have this in writing. As to the courts, they disregard any important evidence to support government decisions. I would not count on any court – human rights court including ,,,

        I suspect that you could quite confidently count on the European Commission for Human Rights who have a link to a panel of various pro bono lawyers who will inform you of your rights in a given situation, if discrimination can be shown to have occurred, and tell you both the law that has been transgressed, and the way in which you can call the perpetrators to task, especially if these are government , national or institutional bodies.

        I believe that the clause in question here would be the diagnosis – as Cancer, which used to be known as ‘the big C’ because most people diagnosed did not survive, is no longer the death sentence that it used to be, and much can be done to stabilise it or obtain/enable a full remission.

        In some cases, however, and this would be confirmed by the doctor or the lab technician, the prognosis is not good, when diagnosed at a late stage. If this is the case, and you have been told your life expectancy is much reduced and the Cancer is inoperable or untreatable, then you could provide that evidence in order to receive ‘special measures’ – an acceleration of the time needed to process a claim, and an increase in allocation.

        The way in which this information seems to have been transmitted is very unsympathetic as, if there is a spontaneous remission or an improvement in prognosis before the end of the 6 month term, it’s unlikely that an ‘overpayment’ would be reclaimed. The spokesperson has also clearly not received adequate training for the post she or he has taken – which is the case as agencies such as ATOS are employed at the lowest rate and peopled by accountants rather than health counsellors.

        Jane, do you work for the DWP? You seem to be falling over backwards to excuse the deplorable response this poor woman was given.

        As you know much about cancer, you will know that every single case of cancer is different. There is never any actual, solid prediction of how the disease will progress, respond to treatment, spontaneously resolve or return. Much can be done, as you rightly say, but much that can be done, does not work in the way hoped and most cancer treatments do cause some harm to the individual, just because of the mode of action of the therapies. Even after treatment stops, the late side effects of treatment can go on for decades. These late effects can be devastating to any quality of life.

        If the cancer itself doesn’t make you unfit for work, then the treatments are very likely to.

        There is absolutely no excuse for some bitter, low level DWP admin officer to speak to anyone in that way, no matter what their illness or disability.

        Perhaps the poor woman who was spoken to so offensively, should have asked the DWP call centre ape if she should forgo treatments so that she could die on time? Maybe her punctual death could be added to her “action plan” ?

    This is Totally Disgusting. I know that these minor civil servants are under a great deal of pressure to be unpleasant, but did they never have parents (unmarried, of course!)? What would they say to someone who treated their mother or father in the same way? Can they sleep at night? I know that, if I was as unpleasant to some poor woman as they just were, I would just go into a corner and weep with shame – no matter WHAT my supervisors threatened. I send the lady my love and best wishes, and sincere hopes that she will find a treatment that cures her; She deserves it. To All those who think that this is a suitable way to react to such a call, well, I hope that they, too, get exactly what they deserve.

    Not in the least bit surprised. When questioning the legitimacy of the DWP’s stance on terminating my benefit. The response I got from the person on the phone was ‘we do this because we can!’ My response was, in a shocked & worried voice, “did you hear that?” The operator said, ‘hear what? I don’t know what you mean” I went on, “Oh my God no!” The operator replied, “are you alright madam only if you’ve finished I have other calls to answer.” I responded, “it’s not me I’m worried about, that noise was your screams when the fires of hell were licking around your putrid soul, I feel so sorry for you. Goodbye”

    everyone should when they ring up dwp record the conversation (by law you have to advise them it is being recorded ) they may put the phone down on you , but the point of it is you will have proof of anything that is said , i would have said feel free to prosecute me if i survive and watch the shit hit the fan , i always ask for real names and job title it annoys the hell out of them but i dont care

        Sorry I forgot something … Use it in an appeal as well.. the sue the hell out of them but always ask their name.. if they don’t they can not touch your claim.. use that in an appeal as well.. there are certain rules and regs Ian Duncan TWAT can’t change but do not want you to know??? any probs get in touch I will do your appeal for you… if any DWP worker had a brain cell it would be lonely

      No, you don’t need to tell them you are recording the call. Recording of a call is legal as long as one of the parties has authorised it. You do not have to inform, them, nor obtain their permission.

      DWP states: ‘the Department requires that Atos Healthcare should carry out a Baseline Personnel Security Standard (BPSS) check on every new employee. There is no requirement to repeat these checks for any individual, provided they remain continuously employed by the contractor’ – this confirms they do not do criminal checks on the Assessors. I sugest everyone to ask their assessor whether they criminal record has been checked.

        Do you understand what BPSS clearance is? It includes a criminal record check. It’s a low standard of background check, but it does check criminal records. The next one up is to tackle terrorism so would be a waste of time and money for call centre staff. It’s a DBS basic disclosure that they do (as well as other things before BPSS is granted, ie. Verifying work history claims, in writing), but it is a criminal record check.

        And no I don’t work for the DWP, I’m in recruitment and deal with clients who require BPSS clearance. A key part of BPSS clearance is a criminal record check, and there are steps above and beyond a CRB/DBS that must be met for someone to be BPSS cleared. BPSS is what allows for extra security when an employer can’t ask exempt questions under the rehabilitation of offenders act (there’s no call centre that can ask these questions directly for a whole ton of reasons).

        This story is disgusting, but please know your facts before spouting things that people may well believe. BPSS is more than just a criminal record check. It’s a higher level of clearance than what you’re asking for, and anything higher than that for something not dealing with national security level issues would be a complete waste of time, money, and resources.

    Not in the least bit surprised – was instructed to come in for WFI (I’m FT carer…). When I called to ask what it was about, was told someone would call me back. They did….’she’ was angry & abusive, ‘don’t have time for this call’….laughed (actually laughed) at me being a carer & told me that as “I did nothing all day” I had “plenty of time to arrange alternative care, it’s easy”.

        lol – I do now….& have apologised to mate I thought was a bit tinfoil hat when he urged me to record everything a while back! Hadn’t thought of the on-line threat but as far as I understand the law, I don’t even have to tell them I’m recording. I do have to consider data provider law on identifying an actual person though (see, I’ve been swatting 😉 )

    I thought the terminal illness rule was approximate? It’s not set in stone like George Iain Duncan Smith should be then dumped in the deepest part of the Thames
    My simple answer to anyone phoning the DWP is record it you can hear a pin drop when you threaten to put the unedited call on-line for all to hear. They normally disconnect the call immediately

      Based on what exactly? I have been spoken to like that. It was jaw-dropping the way the rude, ignorant woman spoke to me. She belittled the role of carers & laughed about it, said she was too busy to answer questions (even though she rang me), got irate when I pointed out a piece of paper she wanted signing was not sent (“hows that my fault”…it certainly would have been mine if not returned) She also lied to me because a WFI is not a mandatory thing for FT carers for severely disabled as she stated. To add insult to injury, she then rang up a day later & cancelled the appointment because SHE didn’t have time….and she had the appointment down for a day later than on the letter she had sent…bit of a problem when you have to arrange alternative care, twice because of their error. There was no apology. Trust me, had I thought it was possible that a DWP employer would ever speak to someone like that, I’d have recorded & reported it. I won’t be so naive again. If you want to know where – quite happy to name & shame Enfield Jobcentre Plus.

      John, who is being offensive now? I worked for DWP and I can assure you that myself and my colleagues treated everyone with the utmost respect. Our calls were monitored and we certainly would have been disciplined very severely if we had been the slightest bit rude. I am not saying that the original story is not true but please don’t judge everyone the same way!

        It’s hard not to judge everyone with one sweep Mary, especially when every time one contacts or is contacted by the DWP one is treated to intimidation, misinformation, misconduct, verbal aggression et al.

        The bottom line is, if you are in a job that requires you to harm individuals and take action that deliberately targets their individual vulnerability, you have a moral choice. You choose to carry out the contract, or you don’t.

        People who choose to carry out the harms meted out to the unemployed, the sick and the disabled have no excuse. They do know that what they do destroys lives and they accept money for doing it. Many will be in denial, but there are swathes of civil servants who enjoy this power they have and use it spitefully.

        It is of no matter that when you worked for the DWP you were held to high standards of propriety Mary, today, those rules don’t exist. The pressure is on for all who can, to carry out those harms, by whatever means. This is how we get to the point where call centre staff can spew forth such unmitigated poison to a woman who has just been diagnosed with cancer.

        We take it personally, because we are going through this. I have no sympathy whatsoever for anyone who defends treating people so badly or who works within the system harming people.

        There is no excuse.

    front line jobcentre staff informed my children that their dad was dying of cancer in front of a queue of people waiting at the desk….nothing surprises me anymore, still disgusted though

      Either way it is no outsider’s business to tell them that their parent is dying… with your permission I would like to know full details and turn your story into a post of it’s own… I think that is the second worst JC story I’ve ever heard, after this one, and it should go viral…

        This happened 12 years ago. My children were 2 and 7 years old. my partner had been diagnosed with terminal cancer the previous week. I was trying to get some benefits as we didnt have an income at the time. After my partner died i went to my local MP to get support to make changes to the system for people dying from cancer. The system did change in that people now get ‘special measures’ but obviously front line staff are still badly trained, uncaring and badly recruited. When I queried about widows benefit another member of staff explained that I would need to be married to receive the benefit and then laughed and said ‘I assume you’ll be getting married then’….. My MP was uninterested in my case and concerns and I felt unable to continue my case at the time as I dipped into depression. Then it felt too late to do anything about it…

    No-one can make a change to a claim over the phone. You need to be sent a form to be filled in by you and assessed by a decision maker. This call will have been recorded. Please advise the lady in question to seek out that recording and bring it to the attention of the press.

    I cannot even begin to tell you how utterly disgusted I am by this unbelievable treatment of a person already trying to come to terms with a death sentence. To be honest I am beyond anger…. How the hell have we been given such crass uncaring people to do such a sensitive job. To whoever dreamt up this crap ruling & the person that took the call I hope karma comes knocking on your door very soon. This Govt. DWP & ATOS should be taken to court for abuse.

    They’re not fit to deal with watching grass grow let alone have control over people in distress.

    The actual contact of the call aside for a moment I just wanted to make a point about the nature of the way the call was handled, as someone who works in a call centre.

    No mention whatsoever of the person who handled the call saying anything at all like ‘I’m sorry to hear that’. A little bit of empathy would go a long way here. I tell people that their broken tv won’t be repaired for free because it’s out of warranty and if I don’t show empathy I’ll get a harsh word from my boss, possibly disciplinary action if it’s more than once.

    So from a call handler’s point of view this is utterly unprofessional and frankly disgusting.

    I’m Canadian my brother died 2010 from Mesothelioma But reading this I could not be more ashamed of my English heritage my dads mother must be turning in her grave to see how low the country of her birth has sunk.I have no idea how this Tory scum can look at itself in the mirror.

    after i won my appeal against atos last year i was told BY the DWP that atos had lost the contract to asses last november obviously another LIE told by the DWP

    I hope the calls are ‘recorded for quality and training purposes’. Play it back and if this was the exact conversation that is a disgrace in any organisation. Even if its true there is a better way to respond. Whoever that was should not be allowed contact with human beings.

    I am a GP and I can tell you that this is not a true story. We are required to certify that a patient is likely to die within six months, but if they are still alive no action is taken and the extra payments continue. Don’t believe everything you read on the Internet!

      Where in the following conversation does the poor lady say that she was told that she has six months to live?

      Lady: I am calling to inform you of changes to my health; I now have cancer.
      DWP: Well?
      Lady: I was told to inform you of any changes to my health.
      DWP: Well, are you going to die?
      Lady: I’m not sure. I’ve only just been diagnosed.
      DWP: Well, I can put you through on the special rules for terminal claimants, but if you don’t die within six months we will prosecute you.

      I do not believe for one second that you are GP. And if you are then due to your lack of intelligence I feel sorry for your patients.

        It is not a question of DWP policy, but of its effect on their workers.

        As Stuart says, if a medical doctor provides a DS1500, the patient gets benefits under the special rules that they are likely to die within six months; if they do not they are not prosecuted for having defrauded the DWP. The patient can rely on the doctor’s prognosis, the doctor is presumed to have signed the form honestly believing it, predictions of death are not expected to be so accurate.

        It is a question of how badly DWP staff are trained, and the effect on workers of mediating wicked policy to claimants. The claimants cannot get money they should be paid, and the telephonist can do nothing. To protect their sanity, some come to hate the claimants. And they are pressured to work faster and faster, to get rid of the clients phoning as quickly as possible.

    God help us is all I can say, this is appauling behaviour, and very Inhumane. Im disgusted by the way this Goverment runs the country, they seem to attack only the weak and ill, but doesnt mind so much in helping others in Crisis.. Surely this cant be right ? Some of these people working for the DWP act like it is coming from their wages, there is no reason or explanation that can justify anyone being treated like this!

    The more stories I hear regarding DWP and their approach to people in need the more I am convinced that the Tory attitude is to attack the poor and needy. This is the cold, uncharitable face of an uncaring government.
