Tory Manifesto Includes Plans To Review Enforced Treatment For The Long Term Sick

April 14, 2015

Benefits And Work report:

To aid their attack on poverty the Tories have also committed to review how people with long-term treatable conditions ‘such as drug or alcohol addiction, or obesity’, can be helped back into work. People who refuse help will face having their benefits cut, as the manifesto explains:

‘People who might benefit from treatment should get the medical help they need so they can return to work. If they refuse a recommended treatment, we will review whether their benefits should be reduced.

There is also a promise of ‘significant new support for mental health, benefiting thousands of people claiming out-of-work benefits or being supported by Fit for Work’.

Whether refusing this help, likely to be primarily online and telephone-based cognitive behavioural therapy, will also lead to benefits cuts was not discussed in the document.

However, there is no doubt that conditions such as anxiety and depression are regarded as ‘treatable’ conditions by the DWP. There is, therefore, no obvious logical reason why they should not be dealt with in a similar way to conditions such as substance dependency, which will very frequently have a mental health element.

To me this is benefit fraud committed by the people we are electing to serve us. I have gained over 50% in weight since I went on my meds the only way to get the weight off would be to stop the meds and no doctor would even think of doing that unless they were replacing it with another.

      Update on Sanctions inquiry

      Gill Thompson
      Stevenage, United Kingdom
      14 Apr 2015 — Dear All,

On 24th March the DWP Select Committee Inquiry’s findings and recommendations were officially published.

      http://www.publications.parliament.uk/pa/cm201415/cmselect/cmworpen/814/814.pdf.

There are also attachments to the witnesses’ written evidence including David’s story.

It proves a rather hard read with page 56-62 listing the recommendations (26 in total).

I record below some of the highlights of the report which I found of some comfort which I hope that many others will too.

      3. Providers’ ability to accept “good reason”
…”we believe that DWP should take more urgent steps to ensure that a more common-sense approach is set out in guidance”. We recommend that DWP’s guidance to contracted providers makes clear that discretion can be applied where providers’ staff are confident that a claimant’s failure to meet a mandatory condition was due to extenuating circumstances beyond the claimant’s control”.

      13. Drawing on specialist advice from health experts
“We recommend that DWP, drawing on specialist advice from health experts, develop guidance on vulnerability which is specifically intended to assist JCP staff in identifying vulnerable JSA claimants”

      25. DWP should make hardship payments available from day one of a sanction period in all cases.
The fact that in January 2015 the most recent data on hardship payments were from 2010–11, which the Committee found highly regrettable, they recommend that DWP publish, on at least an annual basis.

      26. Investigate deaths of benefit claimants.
“We ask that the Department set out the number of peer review cases where the claimant was subject to a benefit sanction at the time of death and the results of any such reviews in terms of policy changes. In addition, DWP should seek to establish a body modelled on the Independent Police Complaints Commission, to conduct reviews, at the request of relatives…”

The Labour Party have committed to accept all the recommendations in the DWP select Committee Inquiry report.
The DWP has made an initial response to the report but it’s disappointing that it made no reference to the select committee’s recommendations which would help protect vulnerable people from the inappropriate use of sanctions. In contrast Labour have already said they would accept all the select committee’s recommendations.

      The DWP said:
“As the report recognises, sanctions are a vital backstop in the welfare system and are only used in a small minority of cases where claimants don’t do all they can to look for work.
“Every day Jobcentre Plus advisers work hard to help people into jobs, and we continue to spend around £94bn a year on working age benefits to provide a safety net that supports millions of people.” Jobcentre advisers make it very clear to people when they first claim benefits what is expected of them, and what the consequences are if they don’t play by the rules. More than 70 per cent of claimants say they are more likely to follow the rules if they know they risk having their benefits stopped. Benefit sanctions are not new – they have been in effect for decades under successive governments and are a vital backstop of the benefits system, encouraging people to engage with the support on offer”.

The Trussell Trust stated over 900,000 people are relying on their food banks (1.4 % of population). Whilst the government maintains the economy has improved – ….. job seekers is down, employment up, a better life for all and sanctions are a last resort – with over 3 million sanctions have been issued so far – it is some last resort!

In the Daily Mail of 8th April George Osborne spoke more on austerity savings, stating by 2017-18 aims to cut a further £12bn from the Welfare Bill, yet just £5bn on clamping down on tax avoidance.

How much more can they punish the poor, vulnerable and innocent?
This is not a numbers game, our loved ones are not statistics, and we must never lose sight – or let the government lose sight – of all the suffering since the new sanctioning regime was introduced in 2012

Thank you again, it would not be possible to get this far without all your help and support and now we must ensure that not only are “lessons learned” but the next government hits the ground running and follows through with the recommendations and stop any further hardship placed on the sick and vulnerable in our society – or we will continue the campaign until it does.

      My deepest thanks,

      Gill

As this would be enforced treatment and therefore a gross violation of the person’s human rights, it would be quite illegal.

It would also violate the ethical and professional guidelines of any healthcare professional the DWP used.

    • April 15, 2015 1:56 pm

That assumes we retain the concept of human rights…..

voting for the conservatives will probably kill off most sick and disabled over the next 5 years. the past 5 years have been very bad with many deaths having been reported on from around the country

some weeks have been very bad with up to 3 deaths per week having to be recorded through welfare reform

the public need to understand that fairness in our society means giving that little be more to those in need and that failure to do so will result in many more deaths over the next 5 years and if left unchecked only the very most disabled will be left alive as those not so disabled or deemed ill enough will be cut adrift from all benefits

the prime minister has made it clear that his party is for the hardworking people only which rules the likes of myself out from voting for him

ONE LAW FOR ONE, ONE LAW FOR ANOTHER

Enforced treatment goes against the guidelines and laws (what little there is for the patient) that means you cannot demand treatment (and treatment includes food and water) from a NHS hospital.

If you disagree with how you are being treated and need help from your next of kind to discharge yourself against the treating doctor’s permission, your relative is arrested for a criminal offence (?) and can be imprisoned for 6 months.

How can the government imposed enforced treatment, when you cannot enforce treatment and food and water, nor have the legal right to be informed of a DNR notice upon you, nor is it a legal offence for medical professionals to neither inform you, the patient, nor your next of kin.

The elderly and disabled have found DNR notices on your their treatment records without ever knowing they had been so recorded by a doctor’s permission.

Neither the nurses nor the hospital healthcare assistants (it is the latter who deal with your direct care) are obliged to inform you, nor are in any trouble for not doing so.

SANCTIONING CAUSES STARVATION – WHY DOES THE GREENS AND LABOUR AGREE? FOODBANKS WERE GOING BACK IN 2006.

Sanctioning people with alcoholism who cannot absorb food properly and obese people, means they will die from starvation faster than average person, that takes about a month.

The prisoners of war in the second world war found that the more weight you carried, the quicker such a soldier died from hunger.

The drug addict has to turn to crime to feed his expensive, continuout habit and therefore sanctions will not bother him at all. He will turn to robbery and she will turn to prostitution.

So enforced treatment will increase crime.

      Sanctions cost taxpayers money.

Doctors are reporting a huge rise in malnutriton hospital admissions.

GPs are talking amongst each other of the great increase in the hunger symptom in kids of Rickets, effecting bone development for life.

What also effects children for life, is the premature birth brought about by their mother being sanctioned and left without food, which continues when her stress from hunger means she cannot breast feed and has to seek some baby milk from somewhere.

Does this mean a new mother must steal?

What significant help for the mentally ill?

A lot of shell shocked (now called post traumatic stress disorder) soldiers, medically discharged from the army, are homeless on the street.

THIS IS THE VOTE OR STARVE ELECTION

Some very old pensioners will vote out of habit and so we will get:

      277 Labour

      264 Tories

      28 Lib Dems

as so many elderly will have died this winter from freezing to death in unheated homes, from the 50 per cent of the unaffordable energy bill being climate change levy, that The Greens think so highly of. It is useful therefore that The Greens will get only the 1 MP they already have.

      THE TORIES HAVE WON

With a severe hung parliament the Tories stay in power in a caretaker government, by the rules of parliament.

326 MPs is the minimum threshold for single party to rule a UK parliament, which no big party will reach, even with a partner as Lib Dems much reduced and UKIP only maximum
      4 MPs.

POOR NON VOTER OUTNUMBERS ALL OTHER VOTERS

The non-voter had a landslide victory in 2010, with the same turnout as 1918 after so many men had died in the first world war, as the winning MPs were in voting areas where most people did not come out to vote.

      HOW YOU CAN CHANGE EVERYTHING

40 Plaid Cymru all of Wales
(rethink Universal Credit – this will bring permanent sanctions for life)
(reduces 8 Tory, 3 Lib Dems and about 20 Labour)

      9 The Left Unity Party
      (Abolish sanctions)

      10 Socialist GB
      Same policies as TUSC

What if you have co-existing medical conditions and the the treatment for one makes the other worse? I have epilepsy, anxiety, depression, high blood pressure and high cholesterol. Treatment for epilepsy can cause high cholesterol, anxiety and depression, treatment for high cholesterol can cause anxiety and depression, treatment for depression can cause high blood pressure, anxiety and depression as well as increase seizures.

I had this problem when I applied for early retirement ATOS claimed that CBT and graded exercise would cure my condition, despite my having tried both and they did not help, which was backed up by my consultants and GP’s and also two ATOS Doctors not involved in the lets deny everyone everything side of ATOS, so this is just the way these things evolve with this despicable government.

What are you thinking?
