Cassette Recorders Can Be Used For PIP Medicals

June 15, 2016

DWP minister Baroness Altmann confirmed in a written statement last month that personal independence payment (PIP) claimants can ask to record their medical assessment. However, they must let the provider know in advance and provide a complete copy of the CD or cassette at the end of the assessment.

Baroness Altmann’s full answer to the question “To ask Her Majesty’s Government what plans they have for recording proceedings at Personal Independence Payment assessments” was:

“The recording of Personal Independence Payment (PIP) consultations by assessment providers is not currently part of the contractual specification for PIP assessments.

“However, claimants can ask to record their own assessment, provided they comply with the conditions put in place: they must:

  • Inform the provider in advance;
  • Be able to provide a complete and accurate copy (CD / audio cassette only) of the recording to the health professional at the end of the consultation; and
  • Sign a declaration agreeing that they will not use the recording for any unlawful purpose.”

It is not clear how long in advance Atos or Capita need to be informed, nor what happens if the provider refuses to allow a recording, though it is known that many individual health professionals refuse to carry out recorded interviews.

The conditions appear to rule out the use of digital recorders, which would be the simplest and lowest cost option for many claimants.

How can people “provide a complete and accurate copy (CD / audio cassette only) of the recording to the health professional at the end of the consultation”? Not technically minded, but surely there would only be one copy – the one the person at the interview would want for themselves.

One way of informing them is in the other info box on the form putting the phrase ALL VERBAL COMMUNICATION WILL BE AUDIO RECORDED. Then 48 hours before call them and say you will be recording it as its your right two tape recorders can be bought for the price of a decent Dictaphone one placed in front of the HP (health professional) and one in front of you they can be bought here https://www.amazon.co.uk/Omega-Reporter-20-Activated-Cassette/dp/B000P8VPTW/ref=pd_bxgy_229_img_3?ie=UTF8&refRID=TVPV7KZ0VYJZQMDY88XZ
So for less than £40 2 recorders and a pack of tapes then your own covert Dictaphone recording just as an extra layer of security

    > Inform the provider in advance;
No law says that I would have to do that. So ‘Nuts’ to that.

    > Be able to provide a complete and accurate copy (CD / audio cassette only) of the
    > recording to the health professional at the end of the consultation; and
Ever hear of Human Rights Act – Article 8 – Right to respect for private and family life.
If wca fraudsters were actually honest there would be no need for any one else to here detailed recordings of my *private life*.
And I would certainly never give a copy of those details, forced out of me by some vulnerable adult abusing unqualified quack, during their under duress (consent or starve) scam.
What’s the real reason they want copies? They get off on their abuse, so it must be just free porn for all of their sicko mates?
    So ‘Nuts’ to that.

    > Sign a declaration agreeing that they will not use the recording for any unlawful purpose.”
I would love to see a copy of that form…
Probably just some scam to try and prevent you from reporting their crime/abuse online.
    Or to steal your copyright.
Whatever it is don’t sign it. You don’t have to, and they can’t force you (without breaking more laws).
    So ‘Nuts’ to that.

Oooooh… I just did a quick search and found – PIP Assessment Guide
    https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/519147/pip-assessment-guide.pdf

    On Page 44 –
    Covert recording of consultations
2.7.11. If the HP notices a claimant is covertly recording their consultation,
the restrictions relating to the recording of consultations should be
explained to the claimant. If the HP is content to be recorded, the
claimant is content to sign the agreement form and the claimant’s
equipment meets the specified requirements, the consultation can
continue. If this is not the case the claimant should be asked to stop
recording. If the claimant refuses, the consultation should be
terminated and the case should be returned to DWP using the return
assessment function with reason failure to participate. The Case
Manager will consider whether the claimant has good reason for
failing to participate in the consultation. If the only reason for failure
to participate is the claimant refused to stop recording their
consultation, it is likely the Case Manager will make a negative
    determination.

“If the claimant refuses, the consultation
should be terminated and the case should
be returned to DWP using the return
    assessment function with reason
    failure to participate”
“…. it is likely the Case Manager will make
    a negative determination”

Lying about ‘failing to participate’ that leads to financial loss.
That is called – Abetting Fraud and/or Conspiracy to Defraud

Is the person who wrote that guide in prison yet?

    And Wales
    http://www.elderabuse.org.uk/Documents/Other%20Orgs/In%20Safe%20Hands.pdf

That happened to me (before I knew any better) the criminal quack just refused to do the assessment, then they lied about me ‘not attending’, then they ignored my appeal and cut *all* money for 3 months.

They only re-started payments after I’d read the fraud act and wrote telling them that if they continued then I’d call the police. (the CAB were blagging legal aid to ‘represent’ me, but the scumbags did nothing).
It’s also all been reported to the police, but there’s nothing but bent cops there, so far.

So if the quack tries it on you then call the police immediately, there and then… and ***keep your recorder/s going***.

Sorry for this v.long one… I could have added more laws/offences, but the ones here are the main ones.
