75,000 ESA Claimants Owed Thousands Each

November 20, 2017

With many thanks to Benefits And Work.

The BBC has revealed that the DWP have made mistakes in calculating the employment and support allowance (ESA) of around 75,000 claimants. The total bill for putting things right, including extra staff time, could be as much as £500 million.

According to the BBC the errors began as far back as 2011 and involved claimants being forcibly moved from incapacity benefit (IB) to ESA. The errors continued through to the 2014-2015 benefit year.

It is not clear yet what the errors involve, the BBC say only that “assessors wrongly calculated the income of around 75,000 claimants.”

If the figures are correct it would suggest that, on average, the cost of putting things right for each claimant will be over £6,500.

The DWP are not denying the allegations.

They have admitted that they discovered the error last December and have so far contacted 1,000 affected claimants.

You can read the full story on the BBC website.

i would advise anyone thinking about claiming to think again as you will need to fill out many forms and it may well cause you more problems then you already have so be warned
they will come to you if they need too

You actually trust them to do the right thing then Nick? with their track record of underhand dealings and lies? if it were me, i would only wait so long then contact to ask if i am one of the affected. or get a solicitor or CAB to do it for me.

    • November 20, 2017 4:29 pm

my dealings with them over 40 odd years now is that they only will abuse those that do not have professional carers

any hint of a active NHS pro carer or lawyer / mp then everything will be ok

my advice would still be to wait and see as there is a good chance the switch over went well

      • November 26, 2017 7:52 pm

i SEE SOOOOOO if your an elderly disabled person with only basic income, fast being swallowed up by higher and higher household bills who cant afford to pay PROFFESSIONAL carers. (or if your a carer looking after your mother or father etc because YOU CARE about them, and dont want them being put ino a home where they could be mentally or physically abused(and that happens a lot these days)///they are the ones that will be the losers simply because they dont have enough money to pay for a proffessional nurse or whatever ,.,,,,,,, not everyone WANTS a proffessional or needs one either. they want someone they know to help them with personal things.if its possible.someone they know they can their home and not to abuse them in any way.. no one should put them in that position you describe. again something for those with not without.

      • November 27, 2017 1:24 pm

yes I’m afraid without professional carers you are the mercy of those that work for the DWP and contractors and your life is definitely at risk no doubt about it

the only person in an emergency you can call is your mp in law to support you

    Denial of back payments DWP:

It could be that it all stems down to Contribution based & Income related ESA.

so CAB and places similar to that no longer have any clout at all. why are they still in existance if thats the case? mind you even our GPs and medical/surgical/psychological specialists dont have any clout now either. years spent studying, and loads of money spent on training to get the highest qualifications in their field and tin pot so called “qualified” assessors both doing these assessments AND at DWP think they know better with no training in those fields at all not even as a medical secretary (and ive known a few of those in my long life .they all pick up so much medical knowledge from the Drs they work for even they are better trained in certain ones of the above fields than any dwp staff. as for jeremy hunt…or any others that have held that post he holds, have, as far as i know, no training in any shape or form in any of tghose fields or even a porter or cleaner in a hospital. and they think they know it all. wont say what i think should happen to the lot of em/ but think you will know anyway.

  5. November 28, 2017 1:19 pm

CAB were excellent back in the 70/80 when I use to help them out but with regret they cannot operate correctly today as to their services being in high demand to such a level they are virtually useless

this also applies to the vast amount of charities that purport to hep people in need

the bottom line is they don’t and in reality end up with being supported by the Samaritans who also are very severely stretched

he/she may be better versed than you Nick// or i for that matter. but chgucking out meaningless linksd like he does helps no one.unless they1. have all day to go to each link and try and understand what they are readinfg.therefore it would be much more helpful if he/she could actuially copy and paste into here what part of the link he is refering to. as for the CAB./unemployed workers and other institutions/charities.if they can no longer help (and i know a lot of the welfare rights places have lost their funding so have had to close, inxcluding the one i worked at myself,) thewn what the hell do people do?let the dwp/tory govt etc stamp on them? give up altogether? lie down and die? surely theres hope somewhere.

Thanks Nick, Yes CAB *used* to be good. But now they’re being Bribed by the DWP To cover up their crimes. Ever heard of any CAB’s calling the Police to report any of the DWPs’ hate crimes? (or any other “advisers” doing that for that matter).

    >”it would be much more helpful if he/she could actuially copy
    >and paste into here what part of the link he is refering to”

    I *Did* –
    “CITIZENS ADVICE BUREAU,1009567, “£2,066,173” , GRANT”

    It’s a 22Mb spreadsheet with 19410 lines (!) I can’t really paste all of it.

If you have spreadsheet software (free ‘Open Office’?) open the file and use “find” (Ctrl-F).

    It’s from here –
“Spend over £25,000 in the Department for Work and Pensions –
A monthly-updated list of all financial transactions spending over £25,000 made by the Department for Work and Pensions, as part of the Government’s commitment to transparency in expenditure.”

As well as the CAB BRIBE I found Bribes to my scumbag yocal council too (Vale of Glamorgan). LOADS of other councils there (and that’s just one month, tho April is the busiest).

    The Bribery Act 2010 –

That is called a LINK. (It is what the “world wide web” was invented for).

    But just for you –

    The Bribery Act 2010 –

1 Offences of bribing another person

(1)A person (“P”) is guilty of an offence if either of the following cases applies.

    (2)Case 1 is where—
(a)P offers, promises or gives a financial or other advantage to another person, and
    (b)P intends the advantage—
(i)to induce a person to perform improperly a relevant function or activity, or
(ii)to reward a person for the improper performance of such a function or activity.

    (3)Case 2 is where—
(a)P offers, promises or gives a financial or other advantage to another person, and
(b)P knows or believes that the acceptance of the advantage would itself constitute the improper performance of a relevant function or activity.

(4)In case 1 it does not matter whether the person to whom the advantage is offered, promised or given is the same person as the person who is to perform, or has performed, the function or activity concerned.

(5)In cases 1 and 2 it does not matter whether the advantage is offered, promised or given by P directly or through a third party.

Then look at sections 2 to 5

They blag DWP cash and we get “Improper performance” (not exactly difficult)

    >”and we do have lives which need our input. even if you dont”

So you are too lazy to click on a link and I have to “type out the bit you refer to” EVERY time?

    >”what the hell do people do?let the dwp/tory govt etc
    >stamp on them? give up altogether? lie down and die?”

Well, no one has given a sh** about this –

    So BLEEP you!

    >”surely theres hope somewhere.”
ONLY if you can be bothered –

UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment

Your referencing PhobosAndDeimos is excellent and although most people will never read your in-depth style as its far too deep and depressing’ it is none the less extremely important at least one member of the public apart from lawyers keep up to date with how laws effecting the sick and disabled are working

Mp’s should also be at PhobosAndDeimos level of expertise but aren’t the same goes for journalists as they always tell me when I’m in their company (I haven’t a clue)

And that is the main reason when in the house of commons and a mp speaks you can be certain it’s complete rubbish irrespective of the topic and that’s why year on year the same old problems just keep going round in ever decreasing circles with never a end in sight to the problem

      • November 29, 2017 5:40 pm

        Thanks Nick.

        >”as its far too deep and depressing’”
        True :/

        >”keep up to date with how laws effecting
        >the sick and disabled are working”
Just years of trying to deal with public sector, hate criminal, abusing vermin and the lying garbage they spout.
(that must be wrong… Google it…. just a few laws, only words, plain english, not difficult for me)

        >”Mp’s should also be at PhobosAndDeimos level of expertise”
        *That* low… we’re dooooomed.
They are at least (met lots years ago), and much higher about *their* laws.
The criminals now are just getting themselves off on their abusing hate crime.
Most are too scared to molest children anymore, so we’re their new target.

        >”same goes for journalists”
(I’ve worked with lots years ago), mostly reality free morons.
Paraphrasing press releases (or just copying). “I can do Journalism me”.
A few generally good ones but corrupt scumbags silenced by employers (eg Atos-BBC or Corbyn-C**k Su*king-Guardian).

And online, especially Fakebook and Twatter, is completely infested with their intimidating abusing lying hate trolls.

UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment
        Article 2
        3. An order from a superior officer or a public authority may not be invoked as a justification of torture.
(Public sector vermin will even deny that)

        Or the “Dunning–Kruger effect” –

        >”(as an ex welfare rights adviser in an unemployed
        >workers centre having done all available courses
        >so i knew what i was doing, ) ”

        Garbage in, Garbage out.

its tragic my daughter also works among mps and lords and says I’m spot on they know nothing and nether she nor I know what can be done about that

they just talk a good talk with no understanding of how a policy is going to work in the real world of which they themselves will just end complaining about slagging each other off year on year

for me when younger I had a chance of becoming a mp’ but in the early seventies turned it down as to me mp’s were just decent and at 18 couldn’t see for the life of me on what value I could possibly add

had I know then what I know now then of course I would have taken the MP route and not the bank of England route which today I bitterly regret

At least my daughter is involved to a very small degree but feel she will look elsewhere for work fulfilment in going forward preferably oversees

  8. November 29, 2017 8:43 pm

i see i am in high company……………. a daughter who WORKS for an MP. good for her. im surprised you didnt drop a name in there, A would be lawyer who thinks, cos an old woman cannot find time to spend all day finding his links and trying to understand them is either TALKING carbage or IS garbage…………. you come and do the housework etc i have to struggle to do every day because it takes me so long to do one job. i come on here in between when i can do no more and need a rest. i cant afford to pay a cleaner. i have to try and do it myself. bit by bit. i understood this blog was about those who were being stood on ,jumped on from a great height aka the sick, jobles, homeless. disabled etc.. i do not need to know those laws in order to have sympathy/empathy and care towards those less fortunate than i am. i have no aspirations towards being an MP.. never have had,. i want to help people as i always have done and as i cant do it either physically or financially now, so i take part in discussions on the loads of others do. and have done. but thank you for pointing out to me that i talk garbage. carry on being high and bloody mighty please do……… your no better than those you pretend to be against. goodnight

    • November 30, 2017 1:44 pm

with much regret I don’t understand your reply as it bears no relation to what I posted

I did not say my daughter works for a mp but among them as a consultant
to they quires that they bring to her for example

      • November 30, 2017 5:26 pm

        Hi Nick,
        Good News Everyone (well kinda)
DWP paid £1129.95 into my bank account yesterday(!!!)

That’s about half of what they stole, but it means I won’t starve or freeze next week. (when the food I have would have run out)

No letters from the DWP but haven’t checked emalis in a few days…

Cool about the MP thing, but (to me) politics is just like religion… Make up any old cr*p and ignore any contrary evidence. Persecute any non-believers.
… Or a Pantomime, oh yes it is, oh no it isn’t, oh yes it is….
Can I vote ‘None of the above’?

        Vile passive aggression.
Clearly you enjoy kicking people when they are down.

No mention if you *now* understand what Bribery is.

        >”either TALKING carbage or IS garbage”

        >”(as an ex welfare rights adviser in an unemployed workers centre having done all available courses so i knew what i was doing, ) ”
        >Garbage in, Garbage out.

I am clearly talking about your “welfare rights adviser.. courses”

        If those “courses” aren’t Garbage…
then you know *all* about Vulnerable Adult Abuse, Care Act, Fraud, Misconduct in Public Office, Torture, Hate Crime, Homicide and making reports to the Police and Social Services? Right?

Or were those “courses” just ‘Witness Intimidation’ and ‘Perverting the Course of Justice’ practicals?

        >”you come and do the housework etc”
So you ignore photos as well as text and links.
And try PTSD. you wouldn’t last a week.

Atos/Maximus/Capita Quacks also do *Garbage* WCA “courses”.
same hate filled “Dunning–Kruger effect” arrogance…
then it’s all “poor little me”, “just following orders”

        this is a LINK
        Garbage in, garbage out –,_garbage_out

      • November 30, 2017 11:55 pm

Glad to see PhobosAndDeimos you have had your shortfall refunded. just hope those who woden’t have a clue about any underfunding get theirs back also in due course

As for hugosmum70 I think she means well ‘it’s just unfortunate that the stress level that the DWP create it muddles the mind even with those with the best intentions

we know first hand how the deaths of the sick and disabled minds get muddled by the DWP before going on to commit suicide as a better option of trying to deal with them

As I have above the DWP are a nasty piece of work in the main and that’s how they will remain for the rest of our lives

      • December 8, 2017 8:18 am

        Thanks Nick,

        > ‘shortfall’.

The torturing, murdering, abusing hate criminal fraudsters at the DWP and their bribed criminal nonce gimps at the yocal council cut *all* payments for four and a half months.

        >’hope those who woden’t have a clue about any underfunding get theirs back also in due course

Most would be dead, or at least homeless.

        >’As for hugosmum70′

‘Ignorance of the law is no defence’
…. as is a blind-eye turning fake ignorance of reality.

What are you thinking?
