Benefit exam exemptions — briefing for professionals

Healthcare Professionals in SolidarityHere is our briefing for professionals on the rules you can quote in letters and reports, for your patient or client to be exempted from the face-to-face exams for ESA or PIP:

  • The regulations built into ESA on “substantial risk to health” — mental or physical.
  • The latest November 2017 PIP guidance to assessors issued by the DWP on exemption where: “there is strong evidence on which to advise on the case and a face-to-face consultation is likely to be stressful for the claimant” or where “someone has difficulty dealing with procedural demands” in circumstances such as “a previous suicide attempt, domestic violence, abuse or bereavement.”

    So how come those ahem “professionals” haven’t even heard of the basics?

    Social Services for all of the DWPs Vulnerable Adult Abuse???

    Care Act 2014 – Safeguarding adults at risk of abuse or neglect –

    P.O.L.I.C.E for all of the DWPs Disability Hate Crimes??? –

    Criminal Justice Act 2003 (section 146) –
    Increase in sentences for aggravation related to disability (Hate Crime) –

    Fraud Act 2006 –
