Claimant: Assessor Came Into My Home And Robbed Me Of My Life

A claimant who was getting the higher rates of DLA has been refused any award of PIP, in spite of being partially paralysed after contracting swine flu eight years ago.
Anna Yellop, 48, has scarring of the brain, takes up to 200mg of morphine a day and is almost completely unable to stand or walk. Her husband is her full-time carer.
She has an adapted Motability vehicle which her husband has to use to drive her to accident and emergency whenever she has a neurological attack, which happens frequently.
Yellop was on the higher rates of DLA care and mobility, but was assessed as not being eligible for any award of PIP.
Not only will Yellop have to return her Motability car if her appeal is unsuccessful, but her husband will also lose his carers allowance.
Yellop had thought the move from DLA to PIP would be straightforward and had not expected to lose out:
“When I read the letter, I burst into tears straight away. I felt completely as if my head had been bashed in.”
“I felt as if someone had just come and totally robbed me of everything – it isn’t just your money, it’s your life.
“It’s your life. It’s everything I’ve gone and lost.
“The assessor came into my home and robbed me of my life.”
Yellop has now requested a mandatory reconsideration.

How so called Health care Professionals can breach their statutory duty of care by giving reports that totally lie about a person’s ability to do any task in an reliable repeatedly and safe way when they even struggle to stand is beyond me. My nurse assessor stated that I walked 50 m when I struggle to do even 10 metres and fall frequently. The reason apparently was because We had a garden! Apparently crutches are an aid to wiping your bottom and able to turn on shower controls, not to mention using kitchen appliances.
I hate to think what they will make of all your medical records that they want to access to, and it seems impossible to deny access if you need benefits such as PIP.
Hopefully the claimant will contact her MP. Many can make a difference. I was one day away from losing my car when Manatory reconsideration gave me extra points. They stated extra evidence, but all I sent was photos of my spine that the nurse stated she had examined and was normal, and the shower control that a crutch was supposed to turn on along with an aid that apparently demonstrated some other ability I did not have.
Fight to the end, and complain. They cannot be allowed to get away with lies. Every one needs to be aware that they try to fail you and will make false assumptions from everything you say, and then make the report up anyway. It is vital you ask for a copy of the report from the DWP
